A sober man is arrested for DUI in Arizona.

According to ABC15 News, Jessie Thornton, 64, said he was recently pulled over for crossing the white line in his lane.

The former Ohio native said police noticed his eyes were bloodshot; but he said that’s because he had been swimming.

An officer asked him to take a field sobriety test. Thornton told the officer he had bad knees and a bad hip.

Thornton said he was put in handcuffs and taken to the station where officers conducted a breathalyzer test.

ABC15 reported that, according to police documents, the test came back with a blood alcohol level of 0.000.

The DUI charge was later dropped.

Thornton claims this was a case of “driving while black.”

He’s hired an attorney.

Police will not comment on pending legal action.
