CLEVELAND – Cuyahoga County prosecutors have dropped a charge against a 7-year-old arrested with a TEC-9.  But the case won’t end there.

Prosecutors believe an adult deserves to be held accountable, and on Tuesday the boy’s mother is set to go to court.

The Fox 8 I-Team first reported the arrest earlier this month off East 79th in Cleveland. A neighbor saw the 7-year-old and two other boys with the TEC 9, a knife and a taser. Then that neighbor called police.

The mother first told the I-Team she didn’t know where the boy had gotten the gun and the child did have an appearance in juvenile court.

But he told police he found the gun inside his home, and it belonged to mom’s boyfriend.

Prosecutors say the police found that the boy was telling the truth.

Duane Deskins, Assistant Cuyahoga County Prosecutor, said, “We did the investigation and we found it was the mother endangering her children by leaving a weapon like that were it was easily accessible on the mantle.”

Deskins said the age of the child put more of the responsibility on the mother.

The mother, Shella Lowe, is facing a misdemneanor charge of child endangering. .

Deskins points out this case should remind all parents about the dangers of weapons in their homes. He also credits that neighbor for getting involved after seeing that TEC-9 in the hands of a child.
