HAVERTOWN, Pa. — Can a worker use the Internet to bite the hand that feeds him? An administrative judge in Pennsylvania says in the case of a Chipotle worker, it’s OK.
The judge has ruled the fast food outlet’s social media policy violates federal labor laws. And that means he saw things the way of a Philadelphia-area worker who trashed Chipotle on Twitter last year. After a customer tweeted thanks for a free food offer last year, James Kennedy complained about workers’ hourly pay.
He took the post down but two weeks later was let go after passing around a petition about workers being unable to take breaks. Under the judge’s ruling Chipotle has to offer to take the worker back — and pay him for back wages.
