Dimora’s Defense Team Files Motion for Trial Delay

A motion to delay the trial of former Cuyahoga County Commissioner Jimmy Dimora was filed by his legal team on Monday.The reason for the requested delay appears to be that the case has unfolded too quickly.

According to a motioned filed electronically with the Federal Court obtained by Fox 8 News, Dimora’s attorneys, William and Andrea Whitaker ask U.S. District Judge Sara Lioi to grant a two day recess, resulting the trial resuming on Thursday, February 23, 2012.

According to the motion, Dimora’s legal team says that the Government represented that the presentation of their case would not be complete until approximately February 27 or 28.

Dimora’s attorneys claim that certain defense witnesses have been subpoenaed to appear on the 27th.

The motion suggests that Dimora’s ability to present a defense will be greatly prejudiced due to the case moving along so rapidly.

According to Mike Tobin with the U.S. Attorney’s Office, Lioi may rule on the motion at her discretion. Tobin says it is possible that Lioi could file an electronic ruling on the matter tonight despite today’s federal holiday.
