CLEVELAND - Hans Wrage, 36, was accused of stealing valuable gems from the Cleveland Natural History Museum back in December 2015.
He was arrested shortly after when officials identified him as the man on security footage from a camera outside the museum.
In documents obtained by Fox 8 News, it shows that the Cuyahoga County Prosecutor has filed a motion to have charges against Wrage dropped.
His legal team says they can show he was elsewhere during the incident and that it was not him on the security footage.
According to the Cuyahoga County Prosecutor's Office, investigators continue to gather evidence in the case, and they reserve the right to refile charges against Hans Wrage.
Defense attorneys plan to ask that the charges be dismissed 'with prejudice,' meaning Wrage cannot be charged with the same crime again.
