PEMBROKE PINES, Fla. (AP) — The Arby’s restaurant chain is apologizing after an employee at a South Florida location was accused of refusing to serve a police officer.

Pembroke Pines Police Chief Dan Giustino says the Atlanta-based company’s chief executive officer and senior vice president of operations contacted him Wednesday afternoon, just hours after Giustino publicly announced the alleged slight against one of his officers.

Arby’s also put out a news release saying the company respects and supports police and that disciplinary action would be taken.

An incident report says police Sgt. Jennifer Martin attempted to order at the Arby’s drive-thru, about 20 miles north of Miami, Tuesday evening.

A manager explained the drive-thru worker, Kenneth Davenport, 19, didn’t want to serve her because she was a police officer, the report states.

Martin was eventually served, but said she no longer felt comfortable eating the food and asked for a refund.

After the incident, however, Davenport’s grandfather told WSVN that his grandson didn’t know it was an officer who was ordering at the drive-thru.

The grandfather told WSVN “he was on duty last night taking orders, he got so overwhelmed with people giving him orders that he asked his manager to help him. I think this is a bad misunderstanding.”

WSVN asked Davenport if he would refuse to serve an officer. He said, “For what? She’s hungry, I’m going to give her some food. We don’t hate cops. We don’t hate anybody.”

WSVN reports that Giustino has accepted the chain’s apology and “considers the matter closed.”

In a second statement, Arby’s representatives said they are still investigating the incident and that there could be two terminations as a result of what happened.
