CLEVELAND, Ohio -- The former Westlake High School student who was charged in an April beating at the school was found not guilty of felonious assault on Tuesday.

But the jury could not reach a verdict on the abduction charge against DeAndrew Smith.

Smith was arrested  after a video of the fight between a 17-year-old junior, and  Smith, 18, was posted to a Twitter account.

School staff found the younger student lethargic in the men's restroom. Smith entered a plea of not guilty and was ordered to have no contact with the victim.
