St. Louis, Mo. — A former husband and wife are in the midst of an historic court case in the Missouri Court of Appeals.

KTVI reports that the couple already has two kids through in vitro fertilization. Although they are divorced, they still have two frozen embryos.

The woman wants to use them to have more kids.

The man argues it would violate his constitutional rights if the woman goes ahead with her plan.

Her lawyers insist the law protects the embryos as children and that she should be able to bring them to full term.

The case is currently in the Missouri Court of Appeals.
