ADAMS COUNTY, Wisconsin – A man pulled over had one creative excuse for his impaired driving, he ate too much beer battered fish.

One officer noticed the smell of alcohol upon walking to the vehicle, but 75-year-old John Pryzbyla told the officer he wasn’t drinking and the smell was from the fish he ate, according to WAOW.

The officer performed a few sobriety tests on Pryzbyla, which he performed very uncoordinated, according to the officer. He also had nine previous OWI arrests on his record.

Due to the number of previous arrests, the legal allowable limit for Pryzbyla to have was only a .02, and his preliminary breathalyzer test read just under the legal limit of .08.

Pryzbyla is now serving time in the Adams County Jail for violating his probation on a previous OWI conviction.
