Lawsuit Filed Against Former Akron Teacher Over Photo

AKRON, Ohio – A Buchtel student has filed a lawsuit against his former math teacher who was fired in May.

Melissa Cairns was fired from the Akron Public School system for uploading a picture of students with duct tape over their mouths to her Facebook page.

The caption she included read, “Finally found a way to get them to be quiet!!!”

The student behind the lawsuit claims the teacher acted maliciously and was racially motivated to “embarrass and humiliate” him.

Cairns was fired from the school system for violating student privacy laws, and not for the duct tape photo. She told a school hearing officer that she regretted posting the photo.

The student filing the claim is being acknowledged in the complaint as “John Doe” in order to protect his identity, according to the lawsuit.

The lawsuit claims the child “has suffered severe emotional injury and is presently undergoing therapy, and is permanently damaged.”

The complaint calls for at least $25,000 in compensatory and punitive damages, as well as legal fees.
