BOSTON (AP) — Police say a baby fell from a third-floor apartment deck and hit a tarp and man working behind the Boston building.

Authorities say the baby boy, who is between 1 and 2 years old, was transported to Massachusetts General Hospital on Wednesday night after falling from a deck on the back of the building. The baby’s injuries aren’t life-threatening.

The man says he was working behind the building when he felt something hit him on the back. When he looked to see what it was, he saw the baby crying and bleeding. He said a tarp that had been put up for a cookout broke the baby’s fall.

Officials say the balcony is not up to code, but that it did not contribute to the accident.

Police are investigating.
