Exclusive I-Team: Video shows Cleveland bailiffs in shootout with tenant

CLEVELAND – Dramatic video just released to the Fox 8 I-Team shows a shootout between a tenant and Cleveland Housing Court bailiffs.

The shootout happened at the Morning Star Apartments on Feb. 25, 2014.

City of Cleveland Housing Court bailiffs Antonio Hall and Paul Marks were sent to the building to evict a man who hadn’t paid rent for seven months.

The man refused to come out and then pointed a gun at the bailiffs, who wrestled the gun away; but the tenant had a second gun.

“He had two guns, and was shooting at the bailiffs,” said Judge Raymond Pianka, Cleveland Municipal Housing Court.  “Those bullets were going everywhere.”

A bullet narrowly missed Marks as he backed away from the door and at least two more shots were fired in his direction. Both bailiffs scrambled to get to a safe area as they returned fire.

The tenant was struck twice, but died of a self-inflicted gunshot wound, according to the Cuyahoga County Medical Examiner.

“It brings to light how dangerous this job can be,” said  Mattew Capadona, Chief Bailiff.

The Cuyahoga County Prosecutor ruled last month that the bailiffs use of force was justified.
