(CNN) — The attorney who represents one of the two defendants charged with raping a 16-year-old girl in Steubenville, Ohio, filed a motion Monday to dismiss the case.

Walter Madison said he expects a hearing on the motion to take place Wednesday.

In his motion, Madison said the trial would violate the due process and equal protection clauses.

His client, Ma’Lik Richmond, and Trent Mays are scheduled to stand trial beginning March 13.
